AB 1234 (Wolk) - As Amended: April 18, 2007

1) A DWELLING THAT CONTAINS AN OLD FLOOR FURNACE, AFTER JANUARY 1, 2014, SHOULD BE DEEMED UNTENANTABLE.

2) THE POLICY OF CALIFORNIA SHOULD BE A REQUIREMENT THAT OLD

This bill provides that a dwelling that contains an elderly floor furnace, after January 1, 2014, shall be deemed untenantable. According to the author, elderly gas floor & wall furnaces have a history of causing house fires & carbon monoxide poisoning resulting in death & injury. The Los angeles Professional Firefighters portray that these elderly furnaces are dangerous because they often lack vents or flues. In support, the Los angeles Rural Legal Assistance Foundation, states that this bill is an appropriate mechanism for replacing elderly heaters that can & do result in death or serious injury.

SYNOPSIS

SUMMARY: Provides that a dwelling that contains an elderly floor furnace, after January 1, 2014, shall be deemed untenantable. Specifically, this bill:

1) Defines "floor furnace" to mean a self-contained, floor-mounted space heater without ducts.

3) Defines "old wall furnace" to mean a wall-mounted, self-contained space heater without ducts that exceed 10 inches that is more 30 years elderly.

2) Defines "old floor furnace" to mean a floor furnace that is over 30 years elderly.

5 ) Provides that it is the owner of Los angeles that elderly floor furnaces shall be replaced in all dwellings in Los angeles.

4) Defines "residential dwelling unit" to mean a detached home, mobile home, manufactured home or a unit in a multifamily structure occupied by either the owner or a tenant.

6) Provides that on & after January 1, 2014, an elderly floor furnace or any unvented furnace or heating facility located in the floor of the dwelling shall not be thought about as

conforming to applicable law, making the dwelling untenantable.

1) Establishes a low-income energy assistance program for electric & natural gas service customers of the investor-owned utilities funded by a surcharge on energy bills. Establishes CARE, which provides a 15 percent bill discount on electric & natural gas bills. Requires the commission to examine methods to improve CARE enrollment, including comparing information from CARE & the Universal Lifeline Phone Service. Requires the commission to ensure that the CARE discount correctly reflects the level of require of customers. (Public Utilities Code Sections 386; 739.1.)

EXISTING LAW:

3) Requires the lessor of a building intended for human occupancy to put the building in to a condition fit for occupation & to repair all later dilapidations which render it untenantable.(Civil Code Section 1941.)

2) Establishes the Low-Income Oversight Board for the purpose of advising the PUC on low-income electric & gas customer issues & serving as a liaison for the PUC to low-income ratepayers & representatives. Requires the PUC, with the assistance of the Low-Income Oversight Board, to conduct an assessment of the needs of low-income electricity & gas ratepayers. Requires the assessment to include an evaluation of the implementation of low-income programs & the effectiveness of weatherization services & energy efficiency measures in low-income households.(Public Utilities Code Section 382.1.)

4) Provides that a dwelling shall be deemed untenantable if it substantially lacks, among other things:

a) Effective waterproofing & weather protection;

c) Heating facilities that conformed with applicable law at the time of installation, maintained in lovely working order. (Civil Code 1941.1.)

b) Plumbing or gas facilities that conformed to applicable law in effect at the time of installation; &,

Fire Danger Presented By Elderly Furnaces. According to the Los angeles Fire Chiefs Association, "Old gas floor & wall furnaces are a proven fire hazard & (are) energy inefficient." The Los angeles Professional Firefighters portray that these elderly furnaces are dangerous because they often lack vents or flues. The author provided 49 news articles of fires that involved floor furnaces, since 2000.Among these fires was two that involved Mr. Kinglsey Melton, a Field Representative for Assembly member Wolk who suffered near-fatal burns, on December 26, 2006.According to the San Diego Fire Department, the cause of the fire was a faulty gas heater under the house.("Kingsley Melton, 29, is in the Intensive Care Unit at the UC San Diego Burn Center Following a Near-Fatal Accident in San Diego on Dec. 26,"Davis Enterprise

COMMENTS: This bill provides that a dwelling that contains an elderly floor furnace, after January 1, 2014, shall be deemed untenantable. According to the author, elderly gas floor & wall furnaces have a history of causing house fires & carbon monoxide poisoning resulting in death & injury. The author further explains that these furnaces are notoriously inefficient in terms of energy consumption. The author states that this bill provides a means to replace these dangerous & inefficient heaters over time, beginning with the most dangerous floor heaters. In support, the Los angeles Rural Legal Assistance Foundation, states that this bill is an appropriate mechanism for replacing elderly heaters that can & do result in death or serious injury.

2.0 INTRODUCTION
The following document describes a detailed evaluation of the air cleaning effectiveness of the Trane CleanEffects™/American Standard AccuClean™ whole house air cleaning method by Environmental Health & Engineering, Inc. (EH&E). Testing was conducted between May & December 2005 in the check home located adjacent to EH&E’s main office in Newton, Massachusetts. The testing was conducted as a joint research project between EH&E & investigators from the Harvard School of Public Health (HSPH).
Aim
The aim of the testing was to quantify the effectiveness of Trane CleanEffects™/American Standard AccuClean™ for removing contaminants from indoor air through comparison to industry standards, the performance of alternative systems, & health-based considerations.
Approach
The performance of Trane CleanEffects™/American Standard AccuClean™ & alternative systems was evaluated in the check home under controlled & well-documented conditions. Measurements were obtained to decide the whole-home particle removal & tidy air delivery rate achieved by Trane CleanEffects™/American Standard AccuClean™ & alternative systems. The effective control of accumulation mode particles by Trane CleanEffects™/American Standard AccuClean™ is of special interest because particulate air pollutants of anthropogenic origin are ubiquitous in this size range. Particles of anthropogenic origin are emitted directly from sources or formed from interactions among gases emitted from various sources. Examples of anthropogenic sources of accumulation mode particles emitted to outdoor air include cars & trucks, electric power plants, & manufacturing operations. Because of their small size, accumulation mode particles in outdoor air easily enter homes by moving through & around doors, windows, & other penetrations in the building envelope. Common indoor sources of accumulation mode particles include cooking & cigarette smoking. Accumulation mode particles also include constituents of biological origin such as mold spores, cat & dog allergen, bacteria, virus, & some pollen.
The control of particulate air pollution in the accumulation mode is important for public health because non-biological & biological particles in this size class have been

associated with increased risks of a variety of adverse health outcomes. Particle concentrations are associated with increased risk of premature mortality & a variety of cardiopulmonary effects, including myocardial infarction (heart attack) & respiratory effects such as bronchitis & asthma attacks. Exposure to mold & positive animal allergens has been associated with asthma exacerbations & lower respiratory symptoms. Notably, a threshold for response of sensitized individuals to particle & allergen exposure has not been demonstrated. For these reasons, the demonstrated ability of Trane CleanEffects™/American Standard AccuClean™ to remove particles rapidly from indoor & to accomplish low steady-state levels of particles inside is anticipated to have a health benefit.
